Protected under the Intellectual Property Act No. 36 of 2003 of Democratic Socialist Republic of Sri Lanka, as amended by subsequent legislation including Acts No. 7 of 2018, No. 8 of 2021, and No. 8 of 2022, and other applicable intellectual property laws.
Personal data is processed in accordance with the Personal Data Protection Act No. 9 of 2022 of Sri Lanka and, where applicable, recognised international data protection standards including the EU General Data Protection Regulation (GDPR) for visitors from the European Economic Area.

3. Services
We provide digital services including but not limited to Shopify development, business websites, SEO, marketing, content systems, client dashboards, invoicing, subscriptions, and related consulting. Specific scope, fees, and deliverables are defined in separate proposals, statements of work, or invoices agreed in writing.
4. Accounts & Access
Client and admin dashboard access requires registration and authentication. You are responsible for safeguarding login credentials and for all activity under your account. We may suspend or terminate access for breach of these Terms or applicable law.
5. Acceptable Use
You agree not to misuse the Platform. See our Acceptable Use Policy for detailed rules. Prohibited conduct includes unlawful activity, unauthorised access, scraping of proprietary content, interference with security, and misrepresentation.
6. Intellectual Property
All Platform materials are owned by ANUSHKA DAHANAYAKE (PVT) LTD unless otherwise stated. See our Intellectual Property Notice. No licence is granted except as expressly agreed in writing.
7. Client Content & Licence
You retain ownership of content you submit. You grant us a limited, non-exclusive licence to use submitted content solely to provide agreed services, operate the Platform, and comply with law.
8. Payments, Invoices & Subscriptions
Fees, payment terms, and billing cycles are set out in proposals and invoices. Payments may be processed through third-party gateways (e.g. Stripe, PayHere). See our Refund & Cancellation Policy.
9. Privacy & Data Protection
Personal data is handled under our Privacy Policy and Data Protection & Governance Policy, including compliance with the Personal Data Protection Act No. 9 of 2022.

11. Limitation of Liability
To the fullest extent permitted by Sri Lankan law, ANUSHKA DAHANAYAKE (PVT) LTD shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, except where liability cannot be excluded by law.
12. Indemnity
You agree to indemnify and hold harmless ANUSHKA DAHANAYAKE (PVT) LTD against claims arising from your misuse of the Platform, breach of these Terms, or violation of third-party rights, to the extent permitted by law.
13. International Users
If you access the Platform from outside Sri Lanka, you are responsible for compliance with local laws. Where international regulations apply (including GDPR for EEA users), our privacy and data protection policies describe additional safeguards.
14. Dispute Resolution & Jurisdiction
These Terms are governed by the laws of Sri Lanka. Disputes shall be subject to the exclusive jurisdiction of the courts of Sri Lanka, without prejudice to mandatory consumer protection provisions that may apply.
